Starting a forex brokerage in Ghana
Ghana does not yet have a licence written for online forex brokers, but it is not a blank page either. The Securities and Exchange Commission is drafting forex guidelines, the Bank of Ghana controls who deals in foreign currency, and the anti-money laundering law already covers forex trading. This page reads each from the primary documents, explains which authorisation does not fit a retail brokerage, and covers the platform and back office you would run.

Who regulates online forex in Ghana
Three bodies and three Acts shape what a founder may do today: the Securities and Exchange Commission under the Securities Industry Act, 2016 (Act 929), the Bank of Ghana under the Foreign Exchange Act, 2006 (Act 723), and the Financial Intelligence Centre under the Anti-Money Laundering Act, 2020 (Act 1044).
Brokers are licensed under the securities law. Under section 109 of Act 929, nobody may carry on business as a broker-dealer, or as any other market operator the section lists, without a valid licence issued under the Act, and section 109(3) requires anyone who wants to act as a market maker to obtain an SEC licence and follow the Commission's rules or guidelines. The definitions in section 216 reach a long way. Securities include commodities futures, contracts, options and other derivatives; a derivative is an instrument whose value depends on an underlying asset such as a commodity, bond, equity or currency; and dealing in securities includes agreements meant to secure a profit by reference to price fluctuations. Whether a particular product sits inside those words is for a Ghanaian lawyer to say.

The Bank of Ghana controls the currency itself. Section 3 of Act 723 says nobody may engage in the business of dealing in foreign exchange without a licence, and counts buying, selling, receiving and paying foreign currency as part of that business. Under section 29, dealing without a licence is an offence carrying a fine of up to 700 penalty units, up to 18 months in prison, or both.
The money laundering law applies whichever licence a brokerage finally holds. The First Schedule to Act 1044 lists trading in foreign exchange, currency market instruments, transferable securities or commodity futures among the activities that make a business an accountable institution, which brings customer due diligence, record keeping and reporting to the Financial Intelligence Centre. Settle how each Act applies to your plan with a Ghanaian adviser. This is not legal advice.

The SEC's forex guidelines are still being written
The SEC has been preparing forex rules for more than two years.

Its request for expressions of interest of June 2024, funded by an African Development Bank grant, sought a consultancy to review the laws, regulations and guidelines governing forex brokerage in Ghana and to develop a detailed guideline on forex brokerage for the Ghanaian securities industry, down to governance, reporting, accounting and tax structures.
The SEC's 2025 Annual Report says the Commission initiated Digital Forex Trading Guidelines during the year to strengthen oversight of online forex trading, and that they were at the market engagement stage, with consultations ongoing among industry participants and other stakeholders.
No draft has been put out for public comment. When we checked the SEC's published guidelines and drafts on 18 October 2026, neither contained anything on forex, so the capital, fees, leverage limits and client money rules a Ghanaian forex licence will carry are not yet known. Treat any figure quoted to you before the guidelines appear with care.
Which licence fits the platform
On our platform the brokerage is the counterparty to every client trade, whether it keeps the trade in-house or covers it with its liquidity provider.

That rules out one Ghanaian authorisation that sounds close. The Bank of Ghana approves FX brokers each calendar year under section 3.13.1 of the Ghana Interbank Forex Market Conduct Rules, and its notice for 2026 authorises 12 of them. Its conditions say an FX broker shall not take the other side of a customer trade or buy and sell foreign exchange for its own account, and must act as an intermediary between banks on the interbank market. That is a wholesale role, not a retail brokerage.
On the securities side, Act 929 describes a broker-dealer as dealing in securities as principal or as an agent, and section 109(3) licenses market makers separately. Which of these the SEC will use for online forex is for the guidelines to settle. Until then, some founders license a company outside Ghana and leave Ghanaian residents out of its client terms; our guide to licences outside your home country compares the usual options, and a Ghanaian lawyer should draw the line on marketing and payments.
The platform itself also answers to the SEC. Directive Dir/001/06/2026 of 23 June 2026 requires a fintech provider or any person operating an online investment or trading platform that performs an SEC-licensed activity to register or license the platform with the SEC, and set 31 August 2026 as the date to finish. The steps are an entry form, a demonstration of the platform to the SEC, feedback, fees where required and a certificate. Tools that solely support back office, non-investor-facing work such as reporting, reconciliation and monitoring are left out, so the client terminal is the part to have ready for that demonstration.

Warnings against unlicensed schemes in Ghana
The SEC warns the public often, in notices issued under sections 3 and 208(c) of Act 929.

Its scam alert of 25 July 2025, Notice No. SEC/PN/002/07/2025, describes schemes that borrow the faces of public figures, use AI-generated voices and videos, hide behind faceless social media accounts and promise unreasonably high returns in a short time. Notice No. SEC/PN/001/11/2025 of 24 November 2025 lists television channels that ran adverts for money doubling schemes, and cites section 144(1) of Act 929 and the Companies Act in warning that public invitations and advertisements for securities-related products without a licence are a criminal offence.
The Bank of Ghana's notice of 27 August 2025 makes the same point about money. It says unlicensed dealings in foreign exchange are prohibited under Act 723, that the cedi is the only legal tender, and that no resident, unless licensed or authorised by the Bank, may price, invoice, receive or make payment in foreign currency for goods or services, online sales included.
For a founder the lesson is about timing. Advertising to Ghanaians before the right licence is in hand is exactly what these notices target, while a firm that can show its licence and a platform registered with the SEC has a ready answer to the first question a careful Ghanaian client asks.

On Android it installs to the home screen in one tap, on iOS through a short guided step, and it updates without any app store. The product list runs from forex, gold and silver, oil and stock indices to crypto and US stocks, and you set each instrument's spread, contract size and digits.
Ghana has not yet published a leverage limit or a negative balance rule for forex clients, so what matters is being able to apply whatever the guidelines say on the day they say it. Leverage is configured per account type and per individual account. The margin engine tracks live equity and free margin, sends a margin call warning and stops out automatically at the levels you choose, closing the biggest losing position first. If an account still finishes below zero, an admin can write it back to zero in the CRM and the change is kept on record. It is the same terminal you would demonstrate to the SEC under its platform directive.

The CRM keeps one record per client, on your own brand, holding their accounts, money, trades, documents and calls, and identity documents are reviewed there before any withdrawal is paid.
Sales staff work a leads pipeline with sources and assignment, under five roles from admin to sales, and each agent sees only their own book. Deposits and withdrawals run instantly or after approval, against the bank and payment details you set, which matters where the Bank of Ghana's currency rules decide how Ghanaian clients may pay. Sensitive staff actions go into an audit trail. Platform pricing is one flat monthly fee, with no setup fee and the first month free.
Common questions
Anything else? Our team answers 24/7.
Does Ghana license online forex brokers?
Not under rules written for them yet. Section 109 of Act 929 requires an SEC licence to carry on business as a broker-dealer, the Act's definition of securities takes in derivatives on currencies, and the SEC's Digital Forex Trading Guidelines are still in preparation.
When will the SEC's forex guidelines be issued?
The SEC has not published a date. Its 2025 Annual Report put the guidelines at the market engagement stage, and no draft had been released for comment when we checked on 18 October 2026.
Are the Bank of Ghana's authorised FX brokers forex brokers in the retail sense?
No. They are intermediaries between banks on the interbank market, 12 of them for 2026, and the Bank's conditions forbid them to take the other side of a customer trade or deal for their own account.
Does the SEC's platform directive apply to a forex brokerage?
Directive Dir/001/06/2026 covers anyone operating an online investment or trading platform that performs an SEC-licensed activity, and asked them to register or license the platform before 31 August 2026. Whether your product is within it is a question for the SEC and your lawyer.
What anti-money laundering rules apply to a Ghanaian forex brokerage?
Act 1044 lists trading in foreign exchange among the activities of an accountable institution. That means customer due diligence, no anonymous accounts, identity records kept for at least five years and suspicious transaction reports to the Financial Intelligence Centre.
Can Ghanaian clients fund accounts in US dollars?
Ask a Ghanaian lawyer before planning it. Section 3 of Act 723 counts receiving and paying foreign currency as dealing in foreign exchange, and the Bank of Ghana's notice of 27 August 2025 says residents may not receive or make payments in foreign currency for goods or services unless the Bank has licensed or authorised them.
Do you help with the SEC application?
No. We build brokerage software. Licensing is work for Ghanaian lawyers and advisers, and we work alongside whoever you appoint.
